These Terms & Conditions ("Terms") govern your access to and use of the website, client portal, and services of Math Solutions Tutoring & Consulting ("Math Solutions," "we," "us," or "our"). By accessing our website, creating an account, purchasing a service, or enrolling a student, you ("you," the "client," or the "parent/guardian") agree to be bound by these Terms. If you do not agree, please do not use our website or services.
1. Our services
Math Solutions provides online mathematics tutoring, homeschool math curriculum, small-group classes, standardized-test preparation, and educational consulting. Our services are educational in nature. While we are committed to high-quality, personalized instruction, we do not guarantee any specific academic result, grade, test score, placement, or outcome. Educational progress depends on many factors outside our control, including student effort, attendance, and individual circumstances.
2. Eligibility & accounts
You must be at least 18 years old to purchase services or create an account. Tutoring services are frequently provided to minors; where a student is under 18, a parent or legal guardian must create the account, provide consent, and accept these Terms on the student's behalf. You agree to provide accurate, current information and to keep your account credentials confidential. You are responsible for all activity that occurs under your account.
3. Payments, credits & billing
- Payments are processed by our third-party payment processor, Stripe. We do not collect or store full payment-card numbers on our systems.
- Certain products are sold as prepaid session credits. Purchasing a session or package adds credits to your account, which are consumed when a session is booked. A booking cannot be made without sufficient credits.
- The Homeschool Math Curriculum and any other plan identified as recurring is a subscription billed on a repeating basis until cancelled. By subscribing, you authorize us and Stripe to charge your payment method on each billing cycle until you cancel.
- Prices are shown at checkout and may change from time to time. You are responsible for all applicable taxes.
- By providing a payment method, you represent that you are authorized to use it and you authorize the charges shown at checkout, including recurring charges for subscriptions.
4. Cancellations, rescheduling & refunds
- Please reschedule or cancel a one-on-one session at least 24 hours in advance. Cancellations made at least 24 hours in advance will have the session credit returned to your account.
- Sessions missed without adequate notice (a "no-show"), or cancelled inside the notice window, may result in the session credit being forfeited.
- Prepaid credits and completed sessions are generally non-refundable except where required by law or expressly agreed by us in writing. Credits are non-transferable and have no cash value.
- Subscriptions may be cancelled at any time and will stop renewing at the end of the current billing period; we do not provide partial-period refunds unless required by law.
- Small-group classes are sold as a sequential multi-session block. Because seats are limited and the curriculum is progressive, enrollment fees for classes are non-refundable once the class has begun, except at our discretion.
5. Small-group classes
Small-group classes require a minimum number of enrolled students to begin and are capped at a maximum. A class begins once the minimum enrollment is met on the announced schedule. Classes are a continuous, sequential curriculum; enrolling after a class has started is permitted at our discretion but does not entitle you to a reduced fee or make-up of prior sessions.
6. Online sessions & recording
Sessions are delivered online (for example, via Zoom). To join a session, both the tutor and student must be signed in to the client portal. Sessions may be recorded by Math Solutions for quality assurance, instructional review, tutor training, and safety purposes. By participating in a session, you consent, and (for a minor) the parent/guardian consents, to such recording. If you do not wish to be recorded, contact us before your session.
7. Acceptable use
You agree not to:
- use our services for any unlawful, harmful, or abusive purpose;
- harass, threaten, or mistreat any tutor, staff member, or other user;
- share, resell, record (except as we permit), or redistribute our sessions, curriculum, or materials without our written permission;
- attempt to disrupt, reverse-engineer, or gain unauthorized access to our systems;
- share account credentials or allow others to use your account.
We may suspend or terminate access for any violation of these Terms.
8. Intellectual property
All content on our website and within our services — including curriculum, lesson materials, worksheets, text, graphics, logos, and the "Math Solutions" name and branding — is owned by or licensed to Math Solutions and is protected by intellectual-property laws. You receive a limited, personal, non-exclusive, non-transferable license to use materials solely for the enrolled student's own learning. All other use is prohibited without our prior written consent.
9. Third-party services
We rely on third-party providers (including Stripe for payments, video-conferencing for sessions, and email and hosting providers). Your use of those services may be subject to their own terms and policies. We are not responsible for third-party services or their availability.
10. Disclaimers
Our website and services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted, error-free, or secure, or that any particular educational result will be achieved.
11. Limitation of liability
To the fullest extent permitted by law, Math Solutions and its owner, tutors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or profits, arising out of or relating to your use of our website or services. Our total aggregate liability for any claim relating to the services will not exceed the amount you paid to us for the specific service giving rise to the claim during the three (3) months preceding the event. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Math Solutions and its owner, tutors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of our services, your violation of these Terms, or your violation of any rights of another.
13. Governing law & disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved exclusively in the state or federal courts located in Texas, and you consent to their jurisdiction. Before filing any claim, you agree to first contact us and attempt in good faith to resolve the matter informally.
14. Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted on this page with an updated "Last updated" date. Your continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
15. Termination
We may suspend or terminate your account or access to our services at any time, with or without cause. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
